It not a question about identities or 'phones'. It can be anything which can act on 'behalf' of a real or legal person, directly or indirectly (with a ton of relations in between). That would only be true in abstract. In reality both phones have an identity. The human creates a new relationship with that new phone, and hopefully disconnects the relationship with the old phone.
